§ 36.03. DEFERRED COMPENSATION PLAN.

  • (A) Approval of establishment. The County Council does hereby approve the establishment of a voluntary deferred compensation plan for its employees, which shall be known as the County Deferred Compensation Plan (Plan) and shall be available to all eligible employees and elected officials of the county.

    (B) Utilization of state plan. The County Council does hereby elect to utilize the State Deferred Compensation Plan document and its investment options as the plan document for the County Deferred Compensation Plan and its funding source.

    (C) Administrator. The County Council does hereby appoint the County Auditor as Administrator of the Plan, and authorize him or her to make deductions from the pay of employees who elect to voluntarily participate in the Plan and to make any other arrangements as are necessary to implement the Plan.

    (D) Authorization of County Board of Commissioners to implement. The County Council does hereby authorize the County Board of Commissioners to contract with Indiana Deferred Compensation Plan, Inc., to be and act as the exclusive servicing manager and enroller for the Plan. The County Board of Commissioners are hereby further authorized to enter into any written agreements with employees of the county who elect to participate in the Deferred Compensation Plan as are necessary to implement the Plan and to comply with the provisions of I.C. 5-10-1.1-7 as, or as designated representative of, the governing body of the county.
